"AN OUNCE OF MEDIATION IS WORTH A POUND OF ARBITRATION AND A TON OF LITIGATION!"
Monika is a long-time Organizational Ombudsman for the California Association of Realtors resolving difficult contractual issues between Realtors, Consumers, Brokers, Managers and Businesses.
Ombudsman Representatives are trained in Dispute and Conflict Resolution. The Ombudsman process can be beneficial for both consumers and Realtor members who need an immediate, informal resolution to common misunderstandings. For example, Ombudsman can field and respond to a wide variety of inquiries and complaints, including general questions about real estate practice, transaction details, ethical practice, and enforcement issues.
As an Organization Ombudsman Monika functions as an intermediary who communicates the concerns of one party to the other over the phone, so a positive relationship can be restored between both parties.
Real Estate Purchase Contracts provide each party duties, responsibilities, and rights regarding the sale or purchase of the real property. Real estate purchase contract disputes typically arise after the contract has been signed by both parties, but before the entire transaction has been completed, both parties will then see the Purchase Agreement terms that they both signed and agreed to follow, and the conditions that the parties agreed to.
The Dispute Resolution Paragraph listed in the California Residential Purchase Agreement states: the Parties agree to mediate any dispute or claim arising between them out of this Agreement, or any resulting transaction, before resorting to arbitration or court action through the C.A.R. Real Estate Mediation Center for Consumers or through any other mediation provider or service mutually agreed to by the Parties. https://www.consumermediation.org
Monika holds the "Mediation of Disputes Arising under the C.A.R. RPA" Certification, and is experienced with Real Estate Contractual Disputes, not only as a twenty (20) year Real Estate Broker, but as an Ombudsman, Mediator, and Arbitrator.
RESOLVING PROPERTY DISPUTES
It's a good idea to state in your rental agreement what steps you will take to remedy a dispute. The best way to resolve disputes is by avoiding them before they even begin. Many problems arise because one party does not know that they have broken the lease agreement, or they're unaware of their rights under the law, take the time to learn, and stay up to date on housing laws.
